Contest Rules
The Contest and free product giveaway are open to citizens of the world while supplies last.
Sponsor:
The ‘All-inclusive Outdoor Adventure Vacation’ Contest and ‘Monthly Columbia Boot Giveaway’ are sponsored by Agion Technologies, Inc. 60 Audubon Road, Wakefield, MA 01880 (herein “Agion”).
Eligibility:
The Contest and free product giveaway are open to citizens of the world. Employees, officers, directors, agents, representatives and independent contractors of Agion are not eligible to participate. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law or regulation. Participants agree to abide by the terms of these official rules and by the decisions of the Sponsor, which are final and binding on all matters pertaining to the Contest. The Sponsor reserves the right to disqualify any participant that it determines, in its sole discretion, is ineligible to participate in the Contest.
Use of automated devices are not valid for entry. Electronic entries must include a valid e-mail address for the entrant. In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” [defined as the natural person who is assigned to the e-mail address by an Internet Access provider, online service provider, or other organization (e.g. business, educational institution, etc.)] of the e-mail address submitted at the time of the entry.
Summary:
In order to enter the Contest, you must enter your name, e-mail address, and full mailing address in the designated windows. You must also fill out a product evaluation form in its entirety and provide us with a picture or video of yourself wearing the Agion Active T-shirt. The t-tester with the most votes as of December 31, 2010 will win the Contest. The winner will be notified within 1 week of the close of voting. Submitted entries will be reviewed weekly. There is a limit of one entry per individual.
To be eligible for the monthly giveaway, you complete all questions on the questionnaire and submit it. Winners of the monthly giveaway will be selected by a drawing by Agion to be held every 30-day period during the contest. Winners will be notified by e-mail and the prize mailed out first class U.S. mail. The decisions of the Sponsor are final. All entries become the property of Agion.
Prizes:
The T-tester with the most votes as of December 31, 2010 will receive a gift certificate for an all-inclusive outdoor adventure vacation for 2 in Glacier National Park from Glacier Guides Company. Airfare vouchers will be provided. The value of the airfare vouchers will not exeed $1000 US Dollars.
We reserve the right to substitute prizes for the survey questions of equal or lesser value at our discretion.
Nothing has a cash value and prizes must be accepted as stated (voucher).
Each monthly winner shall receive the following prize as determined by the Sponsor: 1 pair of Agion protected Columbia Hiking Boots.
Cost:
There is no cost to participate in the Contest. No purchase is necessary.
Dates:
The Contest will begin no later than January 1, 2010, and will end no later than 12 p.m., December 31, 2010. The Sponsor reserves the right, in its sole discretion, to end the contest at any time.
Limitation of Liability:
Agion reserves the right to disqualify any entry for any reason. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Contest, and to cancel, terminate, modify or suspend the Contest at any time. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers’ computer equipment, software, failure of any e-mail to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.
By participating in the Contest, each participant agrees to release and hold the Sponsor harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Contest and/or acceptance, possession, or use of any prize(s) including, without limitation, personal injuries, death, property damages and any claims by third parties or otherwise based on publicity rights, defamation, or invasion of privacy. Entrants acknowledge that Sponsor is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize.
Jurisdiction:
Any dispute that may arise hereunder shall be brought solely in the appropriate state or federal court sitting in Boston, MA and participants consent to the personal jurisdiction and venue of such court.
